If you have registered to subscribe for a FARAD CONNECT (SaaS) account, use the FARAD CONNECT web site and you use the FARAD CONNECT  Apps and available products, suscription benefits and tools offered by the FARAD CONNECT  software,  you absolutely and unequivocally agree to acknowledge and be bound by the following terms  ('Terms').

FARAD CONNECT Account Terms

You must be 13 years or older to use this site.

You are responsible for any activity that occurs under your user account name.

You are responsible for keeping your password, PIN Code and Personal Security Code secure and safe.

You must not spam mail, abuse, harass, threaten, impersonate, hack or intimidate other FARAD CONNECT subscribers.
You must not use the benefits available to you as a subscriber to cross sell, cross promote and or otherwise entice existing subscribers to other organizations in a manner considered unethical of without the consent of the subscribers receiving cross selling or promotion information. If you do these things, your subscription may be de-activated or terminated.

You may not use the FARAD CONNECT subscription services for any illegal or unauthorized purposes. All subscribers around the world agree to comply with all local laws regarding conduct and acceptable behavior.

You understand that FARAD CONNECT is an Enterprise Software and Information Technology Network functioning as a closed ecosystem, bringing together and associating people united by a common interest.

You understand that the FARAD CONNECT website is defined as Software as a Service (SaaS), a software licensing and delivery model in which software is licensed on a account subscription basis and is centrally hosted. It is sometimes referred to as "on-demand" software. SaaS is typically accessed by users using a web browser or mobile device.  SaaS has become a common delivery model for many business applications, including office and messaging software, payroll processing software, DBMS software, management software, CAD software, development software, gamification, virtualization, account, collaboration, customer relationship management (CRM), management information systems (MIS), enterprise resource planning (ERP), invoicing, human resource management (HRM), talent acquisition, content management (CM) and others.

You understand and acknowledge that FARAD CONNECT is not a broker of financial services

You understand and acknowledge that FARAD CONNECT is not a bank, financial institution, government organization, non-for-profit group or political group.

You understand and acknowledge that FARAD CONNECT is not a money services business or a money transmitter.

You understand and acknowledge that FARAD CONNECT is not a barter exchange

You understand and acknowledge that while FARAD CONNECT offers a voluntary subscription referral option, it is not a multi level marketing (MLM), direct sales or affiliate organization. No sales of any kind of any product or services are required at any time. Subscribers can cancel their subscription at any time and for any reason.

The Foundation for Advancing Renewable Actions and Decisions is not classified as a non-for-profit organization. It is a for-profit organization.

You understand and acknowledge that FARAD CONNECT subscriptions are offered as Software as a Service (SAAS) and requires a monthly subscription payment. In return the active subscriber receives certain subscription benefits and a non-exclusive license to utilize the software available to subscribers. We (and our licensors) remain the sole owner of all right, title, and interest in the Services and Software. We reserve all rights not granted under these terms.

To become an subscriber, an individual pays a one-time $0.01  activation fee and first month subscription fee of $5.95. Each consecutive month thereafter the subscriber will be automatically billed $5.95 for their monthly subscription.

BY ACTIVATING A FARAD SUBSCRIPTION, FARAD CONNECT SUBSCRIBERS CONSENT TO HAVING THEIR MONTHLY SUBSCRIPTION FEE OF $5.95 AUTOMATICALLY WITHDRAWN FROM THE METHOD OF PAYMENT THEY SELECTED AT ACTIVATION.
SHOULD A SUBSCRIBER NO LONGER WISH TO PAY A MONTHLY SUBSCRIPTION FEE, THEY CAN EITHER DE-ACTIVATE OR CANCEL THEIR SUBSCRIPTION. THIS FEATURE IS AVAILABLE IN THE PROFILE SECTION OF THE ACCOUNT HOLDER AND ON THE FARADCONNECT IPHONE AND AND ANDROID APPS.

From time to time Farad Connect subscribers may receive a notification polling them if they are still satisfied with their subscription billing schedule. Farad Connect subscribers can cancel their subscription at any time and for any reason.

Farad Connect subscribers must maintain an active subscription in order to receive Farad Connect subscription benefits ( if offered ), including but not limited to Newsletters, Environmental Industry Updates,  Encrypted Mail,  Expo Services, Farad Token Services and Points Participation Subscription Rewards. If a Farad Connect subscription fee is not paid because of a lack of funds on behalf of the FARAD CONNECT subscriber, active subscriptions will convert to dormant status until such time that the subscribers satisfies the $5.95 at which time the subscription will be re-activated. 

REFUND AND CHARGE BACK / DISPUTE POLICY

By activating and paying the subscription activation fee, a new subscriber agrees and accepts to be bound by the FARAD CONNECT  Refund and Charge Back / Dispute Policy. 

FARAD CONNECT will provide an unconditional refund of subscriber activation fees ($5.95 + $0.01 activation) within 15 calendar days of the initial  account registration. This will enable new subscribers to take full advantage of all subscription benefits for 15 full days while making up their minds whether they like and want to continue their active subscription. At the end of the 15th day, subscribers agree to not charge back or dispute the subscription activation fee and waive their rights to a full refund. 

FARAD CONNECT will provide an unconditional refund of the monthly subscription fee of $5.95 within 10 calendar days of the occurrence of such payment. Subscribers effectively can enjoy 10 days of full subscription benefits, while still being able to request and claim a full refund of the monthly subscription fee covering the subscription  period in question. At the end of the 10th day, subscribers agree to not charge back or dispute the subscription payment and waive their right to a full refund.

FARAD CONNECT will provide an unconditional refund of ADVT purchases within 3 calendar days of the purchase date. At the end of the 3rd calendar day, subscribers agree to not charge back or dispute the ADVT purchase transaction and waive their right to a full refund.

You understand that we will only access, view, or listen to your content in limited ways. For example, in order to perform the services, we may need to access, view, or listen to your content to (a) respond to support requests; (b) detect, prevent, or otherwise address fraud, security , unlawful, or technical issues; and (c) enforce these terms. Our automated systems may analyze your content using techniques such as machine learning. This analysis might occur as the content is sent, received, or when it is stored. From this analysis, we are able to improve the subscribed services.

You understand that you can not make traditional deposits in United States Dollars or any other legally denominated and accepted currency into your wallet account.  Funds paid in an account holders wallet account are the result of conditional incentive rewards made by FARAD CONNECT to its subscribers.  Third party funds cannot be deposited in an account holders wallet account.  FARAD CONNECT is not a third party money transmitter. The wallet purchase ADVT function is utilized for the purposes of subscription fees, Farad Token or EXPO payments whereas the prospective Farad Connect subscriber does not have access to or ability to pay for their active account with a debit or credit card. FARAD CONNECT does not charge for or otherwise financially benefit from this feature. No commissions or fees are applied except those charged by the processor of the credit or debit card transaction, normally 3.9% plus $0.30 per transaction. Purchase ADVT credits transactions are considered purchases deposits.

The FARAD CONNECT account wallet Withdraw feature is exclusively established for the withdrawal of FARAD CONNECT  referral rewards or Farad Token proceeds. It is prohibited to utilize this function for the purposes of third party money transmission. Subscribers cannot fund their wallet for purposes of withdrawing those funds outside the scope of what the function was established for. To illustrate, a subscriber cannot use the PURCHASE ADVT function to deposit funds in their wallet for the purpose of then withdrawing those funds to another source as their sole intention outside of the stated purpose of the function. 

When you use the function of PURCHASE ADVT CREDITS you are, in fact, purchasing advanced virtual credits to be used as funds in the following manner:

As an option to use the wallet to pay for your Farad Connect monthly subscription fee.

Purchase content in FARAD Expo and or purchase Farad Tokens (carbon offsets)

The following example is how this great benefit and function cannot be used and any FARAD CONNECT subscriber who willfully and intentionally uses the ADVT function for the purposes of any external source funding as an exclusive application is subject to review and possible account de-activation and subscription termination action.

EXAMPLE: Credit your wallet account with funds paid for with a debit or credit card, then immediately withdraw those funds to an external source without using them for their intended purposes.  

The withdraw function is intended specifically for the purposes of withdrawing FARAD CONNECT  referral rewards extended to Farad Connect subscribers from time to time, Discount Rebates paid to FARAD CONNECT subscribers or promoting in Expo and funds received as a consequence of the sale of Farad Vouchers.

You understand that  FARAD CONNECT is not a retail merchant.  FARAD CONNECT has partnered with third party networks to facilitate out-of-network transactions and does not act as an arbitrator in those transactions nor does it charge a fee or commission for such transactions. The results of transactions in the FARAD EXCHANGE are not based on a reliance on the entrepreneurial or managerial efforts of FARAD CONNECT staff.

You understand and acknowledge that only the information posted on this website is accurate and up-to-date regarding information and explanations referencing the FARAD CONNECT. While you may encounter, experience, hear, view or receive promotional presentations relating to FARAD CONNECT and the FARAD, it cannot be verified that this information is accurate, correct or even endorsed by FARAD CONNECT. Therefor, the only true and correct source of information regarding  FARAD CONNECT is to be found on the official website of FARAD CONNECT at https://www.faradconnect.com

You shall be completely and solely responsible for your own content, product, service or store submissions and the consequences of posting or publishing them. In connection with the content submissions, you affirm, represent, and/or warrant that you own or have the necessary licenses, rights, consents, and permissions to use and authorize FARAD CONNECT to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all user content submissions to enable inclusion and use of the submissions in the manner contemplated by the website and these terms and conditions.

Don't respond to emails asking for your account or personal financial information. Spoof and phishing (pronounced "fishing") are terms coined to describe emails made to look like they've come from legitimate sources and companies but that actually come from identity thieves. These emails warn you of account problems or other urgent issues to trick you into clicking through to a scam website. The scam website then asks you to enter your user name and password or other account information. Once you do this, you've given your information to someone who might use it to do you harm. FARAD CONNECT will NEVER ask you to enter your password or any other personal information, including but not limited to financial information, in an email or send such information in an email. You should only share information about your account once you have logged into the website directly from your browser.

In connection with the user content submissions, you agree that you will not submit material, including video and photography, that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post and submit the material and to grant FARAD CONNECT all of the license rights granted herein.

Unauthorized subscriber registration by proxy is not condoned unless expressed permission has been granted by the registrant to the registrar either verbally or in writing.  FARAD CONNECT accepts no liability for unauthorized registration by proxy and will, at the request of the registrant, either a) remove registrant data or b) provide the necessary guidance to registrant to delete their account.  

You are solely responsible for your conduct and any data, text, information, screen names, graphics, photos, profiles, photography and video clips, links ('Content')that you submit, post, and display on the FARAD CONNECT.

You must not modify, adapt or hack the FARAD CONNECT or modify another website so as to falsely imply that it is associated with FARAD CONNECT.

You must not create or submit unwanted or unsolicited email to any FARAD CONNECT subscriber ('Spam').

URL and EMAIL Rotators

URL and Email Rotators are browser and software programs which direct visitors to other websites often used for cross promotion and cross selling. 

Rotators are often used by affiliate marketing and multi level marketing groups to direct and "blast" traffic. FARAD CONNECT is not an affiliate network, direct sales network or multi level marketing network and therefore FARAD CONNECT subscribers cannot use URL or Email Rotators to spam messages to other FARAD CONNECT subscribers and doing so is a direct violation of the FARAD CONNECT subscriber Spam Policy and subscribers who do so are subject to subscription termination.  Rotator messages are considered "unwanted" and "unsolicited" communications and are not to be used within the FARAD CONNECT network.

You understand that each FARAD CONNECT subscriber can change, cancel or update their Farad Connect subscription at any time and for any reason.

You understand that a FARAD CONNECT subscription offers SaaS software based products and services for a monthly subscription fee. Subscriptions can be cancelled at any time for any reason. Subscriptions are offered as Software as a Service (Saas)

You must not transmit any worms or viruses or any code of a destructive nature.

You must not, in the use of FARAD CONNECT, violate any laws in your jurisdiction (including but not limited to copyright laws).

Those who access or use the FARAD CONNECT website from any international jurisdictions do so at their own volition and are responsible for compliance with local law.

Violation of any of these terms will result in the termination of your FARAD CONNECT subscription. While FARAD CONNECT prohibits such conduct and content on its site, you understand and agree that FARAD CONNECT cannot be responsible for the content posted on its Expo service and, despite our best efforts, may be exposed to such materials and that you use the FARAD CONNECT service at your own risk.  

Unethical behavior

Unethical behavior or behavior deemed inappropriate in the FARAD  CONNECT network by an existing subscriber will not be tolerated. Modifying or adapting FARAD CONNECT for the purposes of causing existing subscribers to be enticed for the benefit of other non FARAD CONNECT related opportunities through malicious or misleading comments is cause for immediate de-activation and/or termination of subscription at the sole discretion of FARAD CONNECT without prior or given notice to the subscriber. 

FARAD CONNECT Network Communications, Messaging, Notifications and Newsletters

The FARAD CONNECT network actively communicates updates, newsletters, App notifications and FARAD CONNECT Mail to its subscribers. These announcements and messages are meant to be informative and share information FARAD CONNECT believes might be of interest to all FARAD CONNECT subscribers. FARAD CONNECT accepts no responsibility or liability, perceived or otherwise, for messages or any kind of communication that has not been read or has been deleted by any account holder. 

Communications Decency Act

FARAD CONNECT and its individual communications properties shall never be treated as the publisher or speaker of any information provided by a FARAD CONNECT subscriber. FARAD CONNECT and its individual communications properties claim this protection under 47 U.S.C. 230 which, amongst other things, protect online intermediaries like FARAD CONNECT.

General Conditions

We reserve the right to modify FARAD CONNECT for any reason, without notice at any time.

We reserve the right to alter these Terms at any time. If the alterations constitute a material change to the Terms, we will notify you via an appropriate method. What constitutes a 'material change' is at our discretion

License; Representation and Warranties
As a subscriber you represent and warrant to us that you have valid legal title to all information listed under your username in the FARAD CONNECT Expo and Exchange facilities. The sale, promotion, distribution and re-sale of Product and Services will not violate any contract by which you are bound or any applicable law or regulation.

Indemnification
You agree to indemnify, defend and hold harmless FARAD CONNECT, its affiliated companies, and their respective officers, directors, employees, and agents against any claim, loss, damage, judgment, settlement, cost, expense, or other liability ( including, without limitation, attorney's fees ) arising from or related to (a) Products listed and sold by you (b) Services listed and sold by you (c) Products and Services sold at your store or place of business as represented in your promotional listing on the FARAD CONNECT EXPO (d) Your alleged breach of any representations or warranty contained in these terms and conditions (e) Any content you provide ( collectively, "Claims"). You will use counsel reasonably satisfactory to us to defend each Claim. If at any time we reasonably determine that any Claim might adversely affect us, we may take control of the defense at your reasonable expense and without affecting your indemnification and hold harmless obligations. You may not consent to the entry of any judgment or enter into any settlement without our prior written consent, which we will not unreasonably withhold.

Publicity and Representation Policy

Publicity Restrictions: 

Subscribers are strictly prohibited from issuing any press release or making any public statement related to FARAD CONNECT, or using the name, trademarks, or logo in any way (including in promotional material) of FARAD CONNECT or any of its affiliates including but not limited to Positron Magnetics and Farad Token without obtaining advance written permission from FARAD CONNECT. Misrepresentation or embellishment of the relationship between subscribers and FARAD CONNECT in any manner is strictly forbidden.

Prohibition on Material Creation: 

Subscribers do not possess the authority to create, distribute, or publish any materials that purport to represent FARAD CONNECT. This includes, but is not limited to, promotional materials, informational content, or any other form of communication that may be perceived as originating from or endorsed by FARAD CONNECT. The creation of such materials without express written approval from FARAD CONNECT is a violation of these terms.

Exclusive Rights to Publish: 

Only FARAD CONNECT has the exclusive right to publish materials that represent its business, operations, or any associated information. Subscribers may only refer third parties to the existing website of FARAD CONNECT at https://faradconnect.com for informational purposes and for obtaining accurate information about FARAD CONNECT. All information provided on the official website is deemed accurate and authoritative.

Violation of Terms and Consequences: 

Any action by a subscriber that involves creating, distributing, or publishing materials outside the scope of what FARAD CONNECT officially publishes, or taking creative ownership of materials not approved by FARAD CONNECT, constitutes a severe breach of the terms and conditions of the subscription. Such violations will result in immediate termination of the subscription. FARAD CONNECT reserves the right to pursue additional legal remedies, including but not limited to defamation claims, against any subscriber found in breach of these terms.

Acknowledgment and Compliance:

By maintaining a subscription with FARAD CONNECT, subscribers acknowledge and agree to comply with these terms and conditions. Subscribers are fully aware that any unauthorized actions related to the representation of FARAD CONNECT will lead to serious consequences, including the termination of their subscription and potential legal actions.

It is imperative that all subscribers adhere strictly to the aforementioned rules and guidelines. FARAD CONNECT is committed to maintaining the integrity and accuracy of its public representation and will enforce these policies rigorously to protect its interests and reputation.
